Write a business brief first
An LLC is formed under state law. The IRS notes that most states allow foreign owners, but the structure, industry, and state requirements still need review. Formation should follow an operating plan rather than replace one.
Write a short brief covering what you sell, where the work takes place, where customers are located, who owns the business, and whether you expect employees, premises, or inventory. Bring this brief to a formation discussion so the advice addresses your intended activity.
Compare the full scope of formation
Ask for a breakdown of initial filing costs, registered agent arrangements, any address service, and ongoing work. Confirm what each address can actually be used for. A formation address should not be assumed to satisfy a financial institution’s separate requirements.
A useful proposal explains why the proposed state fits your circumstances and what needs checking elsewhere. Ask who prepares the records, who files them, which documents you receive, and how corrections are handled.
- Proposed company names and business activity.
- Ownership percentages and management arrangements.
- Where the business will actually operate.
- A written list of included services and recurring charges.
Keep EIN and banking work visible
After formation, organise the company records and discuss the appropriate EIN application route. Ask whether EIN assistance is part of the formation quote or a separate service.
Banking requires its own eligibility and document review. Before choosing a provider, ask about ownership, residence, business activity, address evidence, and any in-person requirements. Treat bank approval as a separate decision rather than an automatic part of company formation.
Prepare for the first year, not just filing day
Set up a folder for formation records, agreements, notices, invoices, and statements. Ask an appropriate adviser to identify tax, licensing, and reporting obligations for your specific operations. Do not assume that no revenue means no filings.
For BOI, distinguish where the entity was formed from where its owner lives: current FinCEN guidance exempts U.S.-formed companies. Certain foreign-formed companies registered in the U.S. may still have reporting obligations. Check the current official guidance before purchasing a filing service.
Use this checklist for your first enquiry
Tell LETHUARD that you are based in Pakistan, describe the planned activity, give your preferred state if you have one, and say whether you need formation only or help with the next steps. We can then discuss a scope and written quote without asking you to submit identity documents through the public form.
